Use of the Site is void where prohibited by applicable law. We reserve the right to modify these Terms at any time. Changes become effective upon posting to the Site, and your continued use following any modification constitutes acceptance of the revised Terms. It is your responsibility to review these Terms periodically.
B. Educational Purpose and No Medical Advice
All content on the Cudumi website and within our online workshop series is provided for general educational and informational purposes only. The content covers topics in chronobiology, circadian science, and biological rhythm research. Nothing on this Site constitutes medical advice, diagnosis, treatment recommendations, or professional health guidance of any kind. The information presented is not a substitute for professional medical consultation, diagnosis, or treatment. You should always seek the advice of a qualified healthcare provider with any questions you may have regarding a medical condition, health concern, or changes to your health-related behaviors. Cudumi does not create a doctor-patient or therapist-client relationship through this Site or its workshop content. Reliance on any information provided on this Site is solely at your own risk.
C. Intellectual Property Rights
All content on the Site, including but not limited to text, graphics, logos, images, video content, workshop materials, written summaries, reference documents, and the overall design and compilation of the Site, is the property of Cudumi or its content suppliers and is protected by United States copyright law and applicable international intellectual property laws. The Cudumi name and logo are proprietary to Cudumi. You may access and view Site content for your personal, non-commercial educational use. You may not reproduce, distribute, modify, transmit, republish, display, perform, or otherwise exploit any content from this Site for commercial purposes without our prior written consent. Unauthorized use of our intellectual property may give rise to claims for copyright infringement, trademark infringement, and related causes of action.
D. Permitted and Prohibited Uses
You may use the Site to access and review educational content about biological rhythms, to submit inquiries through our contact form, and to navigate to related resources we provide. You may not use the Site for any unlawful purpose or in any way that violates applicable local, state, national, or international law or regulation. Prohibited activities include attempting to gain unauthorized access to any portion of the Site or its related systems, transmitting any unsolicited commercial communications, introducing viruses or other harmful code, scraping or harvesting content or data from the Site without authorization, using the Site in any manner that could damage, disable, overburden, or impair its operation, or misrepresenting your identity or affiliation when contacting us through the Site.
E. Disclaimer of Warranties
THE SITE AND ALL CONTENT AND SERVICES PROVIDED THROUGH IT ARE OFFERED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, CUDUMI DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant the accuracy, completeness, or timeliness of any content on the Site. Some jurisdictions do not allow the exclusion of implied warranties, so some of the above exclusions may not apply to you.
F. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CUDUMI AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SITE OR ITS CONTENT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. In jurisdictions that do not allow the limitation of liability for consequential or incidental damages, our liability is limited to the greatest extent permitted by law. Nothing in these Terms limits liability that cannot be excluded under applicable law.
G. Links to Third-Party Sites
The Site may contain links to third-party websites that are not owned or controlled by Cudumi. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites. We do not endorse or make any representations about third-party sites linked from this Site. Accessing any third-party link is done at your own risk, and we encourage you to review the terms and privacy policies of any third-party site you visit.
H. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of Colorado, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or your use of the Site shall first be subject to good-faith informal resolution through written notice to the other party. If informal resolution is unsuccessful within 30 days, disputes shall be resolved through binding arbitration administered in Denver, Colorado, in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive or other equitable relief in a court of competent jurisdiction to prevent the actual or threatened infringement of intellectual property rights. You agree to waive any right to a jury trial and to participate in any class action proceeding related to these Terms or the Site.
I. Severability and Entire Agreement
If any provision of these Terms is found to be unenforceable or invalid under applicable law, that provision will be limited or eliminated to the minimum extent necessary so that the remaining Terms will otherwise remain in full force and effect. These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and Cudumi with respect to your use of the Site and supersede all prior agreements and understandings, whether written or oral, relating to the subject matter herein.
